3. All who continue to work at factories, warehouses, supermarkets, restaurants, convenience stores, liquor stores, pet supply stores and gas stations.
4. Any person who continues to work during the COVID-19 crisis whose business is considered “essential”.
Any essential worker who tests positive for COVID-19, whether or not they show symptoms, become ill, or lose time from work, should protect his/her rights under the New York State Workers’ Compensation Law (WCL).
YOU MUST NOTIFY YOUR EMPLOYER IN WRITING AND ORALLY OF YOUR DIAGNOSIS WITHIN 30 DAYS.
Under the WCL, you may be entitled to monetary and medical benefits. You may receive monetary benefits for lost time and reimbursement for any sick or vacation allowance that you may receive from your employer. The medical benefits cover necessary treatment, including, doctors’ visits, therapy visits, medication, etc, that you require now and in the future.
